1. Provider and scope
These terms apply to orders placed through the CoolMyPeps online store. The provider and contracting party is Maximilian Hundt – CoolMyPeps, In den Langen Äckern 6, 64646 Heppenheim (Bergstraße), Germany, email: support@coolmypeps.com, phone: +49 176 62496671.
Mandatory consumer protection rules remain unaffected by these terms.
2. Formation of the contract
The presentation of products in the online store does not itself constitute a binding offer. By submitting an order using the designated order button, you make a binding offer to purchase the products in your cart.
An automatically generated order receipt or confirmation initially documents receipt of the order unless it expressly states that we have already accepted your offer. The contract is concluded when we expressly accept the order or dispatch the goods.
3. Prices and payment
The prices displayed in the store and at checkout apply. The total price relevant to your order, including mandatory price components that must be disclosed before ordering, is shown before you submit the binding order.
Shipping to the European countries we serve is currently free. The payment methods available at checkout and any additional terms of the relevant payment service provider are shown before the order is completed.
4. Delivery
We deliver to the European countries selectable in the store or at checkout. Usual delivery time is approximately 7–10 days. Individual deliveries may take longer. Statutory rights in the event of delay remain unaffected.
For consumer sales, the risk of accidental loss or deterioration generally passes only when the goods are handed over to you or to a third party designated by you, subject to mandatory law.
5. Retention of title
The goods remain our property until payment has been made in full.
6. Withdrawal and voluntary returns
Consumers generally have a statutory right of withdrawal for distance contracts. Details, model withdrawal information and our additional voluntary return option up to 30 days are available on the “Returns & Right of Withdrawal” page. The voluntary return option does not limit the statutory right of withdrawal.
7. Statutory rights for defects
Statutory rights relating to defective goods apply. Any voluntary guarantee or goodwill arrangement does not limit those rights.
8. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. Liability under mandatory statutory provisions, including product liability law, also remains unaffected.
In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the typical, foreseeable loss. Otherwise, liability for loss caused by slight negligence is excluded to the extent permitted by law.
9. Product information
CoolMyPeps is an electrical cooling device. Whether it is suitable for storing or transporting a particular vial, pen or other temperature-sensitive product depends on that product’s own manufacturer instructions, storage and transport requirements and, where applicable, medical guidance.
10. Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
11. Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not deprive them of protection granted by mandatory provisions of the law of their country of habitual residence.
12. Final provisions
If an individual provision of these terms is or becomes invalid, the statutory rules and the remaining provisions remain unaffected.
